MODIFICATION OF ORDER DETAILS

If We have already completed the pattern specification for Your skydiving or tunnel suit, We cannot implement certain requests like the change in measurements but will attempt our best to make component changes.

3. Suit Production Stage: Sewing Construction Started/Completed:

Once the factory has initiated or completed the sewing construction phase of Your suit, implementing changes becomes more challenging. While We will make every effort to accommodate Your request, the feasibility of such changes will depend on various factors. If the requested modifications cannot be integrated due to the advanced stage of production, regrettably, We will be unable to implement Your request.

Cost of Modification:

We will communicate with You to get Your final consent on the order component modification as per the best available choices. After You confirm the requested changes and pay additional costs, if any, we will proceed to update Your order, and You will receive an email confirmation stating that Your order has been updated to reflect the requested changes. You can also monitor the order update and status by logging into Your APX Suit’s Account. No reduction of cost or refund claims will be entertained for modification of components.

Modified Delivery Time:

2. Resolution Options:

In the event of a measurement error, APX Suits offers the following resolution options at its discretion:

a. Remake of Suit: We can remake a new suit from scratch at a discounted price, with up to 20% discount of the original cost of the new suit.

b. Partial Refund: Alternatively, You may opt for a partial refund equivalent to 15% of the suit's original purchase value. Please note that Stripe Payment Gateway incurs a fee for processing refunds, and this fee will be passed on to the Customer in this instance.

3. Customer Discontinuation:

Should You choose to discontinue the resolution process, We respect Your decision and wish you well with your existing Suit. We represent that not all situations may warrant resolution, and We appreciate Your understanding.

The Product is warranted to be free from defects under normal use and service for a varied period as categorized hereunder depending on the nature of the defect from the date of delivery unless otherwise specified in the order confirmation.

One-Month Warranty

We provide a warranty period of either one English calendar month or thirty days (whichever expires first) for the following defects:

We provide a twelve-month warranty for the following defects:

What Is Covered?

Our warranty covers the listed defects within their respective warranty periods, as stated above.

What Is Not Covered?

While we strive for perfection, there are certain situations and issues that fall outside the scope of Our warranty, which include, without limitation:

1. Normal Wear and Tear: Over time, even the best skydiving or tunnel suits may show signs of normal wear and tear. These include minor scuffs, abrasions, or color fading due to regular use.

2. Improper Use or Care: Damage resulting from misuse, abuse, accident, neglect, improper storage, improper maintenance, or failure to follow Our care instructions is not covered.

3. Alterations or Modifications: Any unauthorized alterations or modifications made to Your APX Suit will void the warranty. This includes any adjustments, repairs, or alterations not performed by APX Suits or its authorized service providers.

4. Fit and Measurement Errors: APX Suits are custom-made to your measurements. Fit issues arising from measurement errors or changes in body size are not covered under Our warranty.

5. Third-Party Components: Any third-party components or accessories added to Your suit, such as grippers or pockets, are not covered by Our warranty.

6. Loss or Theft: Our warranty does not extend to cover lost or stolen suits.

Customer Responsibility:

APX Suits strives to provide the perfect fit for Your skydiving or tunnel suit. However, the Customer is solely responsible for accurately measuring themselves following the measurement guides provided to You or displayed on Our Website from time to time. If the Product does not fit properly due to incorrect measurements taken by the Customer, this warranty will not apply.

Warranty Claim Submission Deadline and Liability Exemption:

Warranty claims with APX Suits are considered valid if they are submitted within a strict timeframe starting from the date of delivery to the Customer's designated delivery address. The Customer's failure, for any reason whatsoever, to promptly raise a Warranty Defect Claim within this specified timeframe results in an irrevocable exemption of APX Suits from any liability under applicable laws. It is the sole responsibility of the Customer to thoroughly inspect and assess the delivered Product immediately upon receipt at the designated delivery address. Customers are strongly urged to diligently conduct this inspection to identify potential defects or issues covered by the warranty.

How to Make a Warranty Claim

If You believe Your APX Suit has a defect covered by Our warranty, please follow these steps to initiate a warranty claim:

1. Submit a Claim: Log in to Your APX Suits Account and visit the “Contact APX” section in Your “Profile Page” and submit a warranty claim by filling out the form details. Provide detailed information about the issue as instructed and clear photographs/ videos if requested. To validate Your warranty claim, You may need to submit proof of purchase, such as a copy of the receipts, and some details about You as may be required and requested from You. If You are unable to do so, please kindly email your concerns to warranty@apxsuits.com.

2. Assessment: Our team will carefully review Your claim, assess the defect, and determine if it falls within the warranty coverage.

3. Resolution: If Your claim is approved, we will work with You to resolve the issue based on the severity of the defect. This may involve repair, replacement, partial refund, or voucher, depending on the circumstances. APX Suits will, at its discretion and as permitted by law, choose one of the following options:

   i) Repair the Product at no charge, using new parts.   ii) Exchange the APX Suit with a newly manufactured one from new parts, which is functionally equivalent to the original Product.

4. Return Process: If Your suit needs to be returned for assessment or repair, We will guide You through the return process.

5. Shipping Costs: The Customer is exempted from bearing shipping costs associated with returning the Product or getting delivery of repaired or new Products for Warranty Service. The APX Suits will provide instructions on how to proceed with the return. Please go through Our ‘Return Shipping’ provision under the Shipping and Delivery Policy for details.

6. Stay Informed: Throughout the warranty process, We will keep You informed about the status of Your claim and any necessary actions.

Additional Information

Warranty Exclusivity:

To the fullest extent permitted by law, this warranty is the sole and exclusive remedy and supersedes all other warranties, conditions, terms, undertakings, and obligations, whether express or implied, statutory, or otherwise. The APX Suits specifically disclaims any implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability:

By agreeing to these Terms, You explicitly acknowledge and accept that APX Suits' liability for any damages arising from the use of the Product, including damages to the Product itself and any personal injury or property damage, shall, under all applicable laws, be capped at a maximum limit not exceeding 120% of the total amount paid by You for the purchase of the Product.

Waiver of Rights:

The APX Suits' failure to exercise any of its rights under this warranty does not constitute a waiver of those rights.

Governing Law and Jurisdiction:

This warranty and any disputes arising from the use of the Product will be governed by the laws of Australia. In case any part of this warranty is determined to be invalid or unenforceable, the remaining provisions or parts of the warranty shall remain in full force and effect.

1. Introduction:

This Magnetic Coupling Device Warranty Disclaimer ("Disclaimer") issued by APX Suits (hereinafter referred to as "We," "Us," or "Our") serves as a comprehensive guide regarding the use of the APX Skydiving Suit's Magnetic Coupling Device (hereinafter referred to as the "Product," “Device,” “Magnetic Couplets,” “Magnetic Couplers,” or “Magnetic Coupling Device”). The Product includes high-power magnetic couplets with opposite polarities designed for use in place of conventional buttons, zippers, or any other kind of less efficient fasteners.

2. Magnet Type and Description:

APX Suits employs NdFeB (neodymium-iron-boron) magnets within the magnetic coupling device of Your skydiving and tunnel suits. NdFeB magnets are a class of rare-earth alloys comprising neodymium, iron, and boron; they are among the strongest permanent magnets commercially available. NdFeB magnets are widely used in various applications, including electric motors, speakers, headphones, magnetic fasteners, and many other devices and Products where strong and compact magnetic properties are required. As these magnets play a crucial role in ensuring robustness and reliability, APX Suits entrusted them with crafting the most secure and efficient magnetic couplers for your Skydiving Suits.

3. Limited Durability Warranty:

While We have taken extensive measures to ensure the durability and longevity of the Magnetic Coupling Device, We can provide a limited warranty for the durability and functionality of the magnetic couplers as described in this document. This limited warranty covers the magnetic couplers' performance for a period of twelve months from the date of delivery ("the Warranty Period"). During this period, if the magnetic couplers fail to perform as intended under prescribed use and care, we will, at our discretion, repair or replace the defective components.

4. Potential Harms and Risks:

The use of high-power magnetic couplets in the Skydiving Suit may result in various risks and harms. Some of the potential risks and harms are outlined below for exemplary purposes only; the examples are indicative, not exclusive. Please exercise utmost care and prudence when handling the device to prevent injuries and damage.

4.1. Magnetic Interference: The powerful magnetic couplets may interfere with electronic devices, causing malfunctions or data loss. Magnets even have the potential to erase data stored on magnetic media, including but not limited to credit cards, debit cards, hard drives, etc. Please ensure that Magnetic Couplers are kept well away from these items to prevent data loss.

4.2. Interference with Pacemakers: The magnetic fields generated by the Product may disrupt the proper operation of pacemakers and other electronic medical devices, leading to potential health risks. We recommend You keep magnets at least 6 inches (15 cm) away from such devices. Before using the Product, especially if You have any medical devices or health concerns, We strongly advise consulting experts or physicians to ensure it is safe for Your specific situation.

4.3. Injury: The strong magnetic force of the couplets may cause serious injury if not handled with caution, including but not limited to pinching, bruising, or scratches when the Product is not handled with care or when it comes into contact with other magnetic objects. Keep magnets away from fingers and other body parts, as they can pinch or cut skin when attracted to each other. Do not place magnets near sensitive body parts, such as the eyes, brain, or heart.

4.4. Clothing Damage: The powerful magnets may damage or tear clothing in situations like if not handled carefully, are not properly aligned during fastening, etc., they can create pressure points on the fabric, leading to tears or damage affecting the overall appearance and functionality of the Skydiving Suit.

4.5. Allergic Reactions: Some individuals may experience skin irritation or allergic reactions when the Product comes into direct contact with their skin.

4.6. Not Suitable for Children: Magnets may not be appropriate for use by children, especially under the age of 14. Children should be supervised when handling magnets, as they may not fully comprehend the risks and potential dangers associated with their use.

4.7. Fragile and Brittle: Magnets are fragile and brittle and can break or shatter if dropped or subjected to excessive force. Handle with care to avoid damaging the magnets.

4.8. Flammable: NdFeB magnets can ignite flammable materials, such as paper and gasoline. For safety reasons, Magnetic Couplers should be stored away from such materials to reduce the risk of fire.

4.9. Interference with Compass: NdFeB magnets can interfere with the operation of compasses and other navigation equipment. A minimum distance of at least 6 inches (15 cm) should be maintained between magnets and these devices.

4.10. Body Piercings: Magnets can interfere with the operation of body piercings, such as tongue and naval piercings. For safety, magnets must be kept at a safe distance from body piercings.

5. Assumption of Risk:

Using the APX Suits with Magnetic Couplers, You acknowledge that You have read, understand, and accept the potential risks and harms associated with high-power magnetic couplets, as outlined in Clause 4 above. You agree that You are using the Product at Your own risk, and We shall not be held liable for any damages, injuries, or losses arising from its use.

6. Exclusive Remedy:

Your exclusive remedy for any claim under this warranty is limited to the repair or replacement of the defective components of the Magnetic Coupling Device, as determined by APX Suits. In no event shall Our liability exceed 120 percent of the Product's purchase price.

7. Warranty Claim Process:

During the Warranty Period, if You encounter any issues with broken magnets or manufacturing defects, APX Suits retains the sole discretion to either replace the defective parts or provide a replacement suit. The Company will organize return shipping for the faulty Product. Please adhere to the guidelines provided in the APX Suits Return, Refund, and Exchange Policy and APX Suits Warranty Disclaimerabove along with this Warranty Disclaimer to initiate any warranty defect claims for our Products. 8. Exclusions from Warranty Coverage:

This limited warranty does not cover issues resulting from the following without limitation:

8.1. Negligence or Misuse: This limited warranty explicitly excludes coverage for any damages arising from negligence, misuse, improper care, or any utilization that deviates from Our Product guidelines. Such instances shall not fall within the ambit of this warranty.

8.2. Unauthorized Alterations: If the Product undergoes alterations, modifications, or repairs executed by unauthorized third parties, or if any attempts are made to dismantle or extract magnets from the suit, the warranty shall be rendered null and void.

8.3. External Factors: This warranty does not cover damages caused by external factors, including but not limited to accidents, fire, water, or acts of nature.

8.4. Normal Wear and Tear: Regular wear and tear resulting from typical usage are expressly excluded from coverage under this warranty.

8.5. Health-Related Issues: Prior to using the Product, especially if You have any medical devices or health concerns, it is strongly recommended that You seek expert advice from qualified physicians or specialists to ensure the safe usage of Magnetic Couplers in consideration of Your specific circumstances. This warranty does not extend to issues related to Your health or medical devices.

9. Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR MISHANDLING OF THE PRODUCT, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

This Disclaimer shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of laws principles.

This "Out-of-Warranty Repairs and Replacements" Policy (“Policy”) outlines the Terms and conditions governing repairs and replacements for APX Suits Products beyond the standard Warranty coverage. It is essential for the Customers to read and understand these provisions before seeking out-of-warranty services.

1.1. Repairs Beyond Warranty Coverage:

APX Suits recognizes that circumstances may arise where repairs or replacements are necessary but fall outside the scope of the standard warranty provisions as outlined in Our Warranty Disclaimer above. To accommodate such requests from Our customers, we offer a unique option of repairing or replacing their skydiving and tunnel suits beyond the warranty period and coverages, subject to the following Terms and Conditions:

a) Cost Responsibility: Customers are responsible for covering all expenses associated with out-of-warranty services, including shipment costs.

b) Evaluation and Discretion: Though APX Suit emphasizes no fixed time frame for requesting out-of-warranty repairs, these requests will be evaluated on a case-by-case basis and will be subject to APX Suits' discretion. APX Suits reserves the right to assess each out-of-warranty repair or replacement request individually, considering factors such as the nature of the issue, the suit's condition, and other relevant circumstances.

1.2. Shipment Instructions and Customer Agreement:

a) Shipment Instructions: Customers must await specific instructions from APX Suits regarding their repair or replacement requests. Shipment arrangements should only be made as directed by APX Suits. Detailed return instructions, including the return address, will be provided after acceptance of the request and on receiving payments for the service.

b) Cancellation and Payment Forfeiture: APX Suits reserves the discretion to either decline an out-of-warranty repair or replacement request in its entirety or carry out a partial repair based on an evaluation of the actual condition of the suit upon receiving the shipment. If the suit's condition is assessed irreparable by us, or if it does not align with the specified repair or return request, APX Suits may opt to return the suit without conducting any repair or replacement. In such cases, APX Suits may choose to forfeit all or a portion of the payment made by the Customer, with any remaining balance retained for adjustment against future orders.

1.3. Assumption of Risk:

Customers acknowledge and agree that by sending their suits for repair, they assume all risks associated with the repair process. In the event that the suit is partially or permanently damaged during repair, Customers waive any rights to dispute or claim compensation. Such incidents will always be regarded as unintentional mistakes or failures, and Customers release APX Suits, its employees, service providers, and any other involved entities from any liability under applicable laws and regulations.

1.4. Warranty Exclusion:

No warranty is extended to repaired or replaced suits under this out-of-warranty service.

1.5. Information Requirements:

Customers may be required to provide measurement details, images, videos, or any other relevant information as or when requested, both before or during the repair or replacement process.

1.6. Time Frame:

No specific time frame is assured for the completion of out-of-warranty repairs or replacements unless what is expressly agreed upon in writing between the Customer and APX Suits.

1.7. Satisfaction:

You hereby explicitly acknowledge and agree that no rebate, refund, or free rework will be provided by APX Suits in the event of Your dissatisfaction with the repair or replacement.

1.8. Quality Standards:

APX Suits does not guarantee to maintain the standards or quality as offered at the time of accepting the original purchase order from the customers for the suits in the case of out-of-warranty repairs or replacements.

1.9. Policy Amendments:

You do hereby acknowledge and agree that APX Suits reserves the right to amend this Policy at any time by posting the amended version on the Website without further notice or consent from the customer. Customers are responsible for reviewing the most current version of this Policy.

1.10. Cost Agreement:

Once agreed upon, no request for a change in cost by the customer will be entertained. However, the Customer agrees to bear any additional costs requested by APX Suits during the repair or replacement process, understanding that the actual cost may vary due to various factors related to the service.

1.11. Entire Agreement:

This Policy constitutes the entire agreement between the Customer and APX Suits regarding the subject matter herein and supersedes all prior or contemporaneous agreements, understandings, representations, and warranties, whether written or oral.

1.12. Severability:

If any provision of this Policy is found to be invalid, illegal, or unenforceable, the remaining provisions shall not be affected and shall remain in full force and effect.

1.13. Waiver:

The failure of APX Suits to enforce any right or provision of this Policy shall not be deemed a waiver of such right or provision.
